Terms of Service

1. Who we are

Neesh ("Neesh," "we," "us," or "our") operates a two-sided online marketplace and mobile application (the "Platform") that connects clients ("Clients") with independent beauty and art professionals ("Masters") who offer in-person services such as makeup, hair, nails, lashes, brows, and barbering. The legal entity operating Neesh is NEESH LLC, located at 300 S Beverly Dr, Suite 203, Beverly Hills, CA 90212, USA. By accessing or using the Platform, you agree to these Terms of Service ("Terms").

2. The Neesh marketplace

Neesh provides the technology that allows Clients to discover Masters, book appointments, and pay for services, and that allows Masters to list services, manage bookings, and receive payouts. Masters are independent professionals and are not employees or agents of Neesh. Neesh does not provide beauty or art services itself and is not a party to the service relationship between a Client and a Master, except as the facilitator of booking and payment.

3. Eligibility & accounts

• You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account.
• You agree to provide accurate, current, and complete information and to keep it up to date.
• You are responsible for safeguarding your account credentials and for all activity under your account.
• Masters must provide valid identity and payout information and complete onboarding with our payment processor, Stripe, before accepting bookings.

4. Bookings & payments

When a Client books a service, the listed price (shown in US dollars, USD), together with any applicable taxes and service or booking fees, is presented before the Client confirms. Payment is collected at the time of booking. Neesh uses Stripe as its third-party payment processor; by paying through the Platform you also agree to Stripe's applicable terms. Neesh acts as the platform of record for the transaction: Neesh collects payment from the Client, retains its commission, and remits the balance to the Master via Stripe Connect after the service is completed.

5. Fees & commission

Neesh charges Masters a commission of 20–30% of the value of each completed booking; the exact rate applicable to a Master is set out in that Master's agreement. Neesh may also charge Clients a service or booking fee, which is disclosed at checkout. Payment-processing fees charged by Stripe may apply. Neesh may change its fees prospectively with reasonable notice.

6. Cancellations & refunds

Cancellations and refunds are governed by our Refund & Cancellation Policy, which is incorporated into these Terms by reference. Please review it before booking.

7. Responsibilities of Masters

• Hold all licenses, permits, and certifications required by law to provide their services.
• Comply with all applicable health, safety, sanitation, and consumer-protection laws.
• Accurately describe their services, pricing, availability, and qualifications.
• Provide services in a professional, safe, and non-discriminatory manner.

8. Responsibilities of Clients

• Provide accurate booking information and disclose relevant allergies, sensitivities, or health conditions.
• Attend appointments on time and treat Masters with respect.
• Pay all amounts due for booked services.

9. Reviews & content

Clients may submit reviews and other content. You grant Neesh a non-exclusive, worldwide, royalty-free license to use, display, and distribute content you submit in connection with the Platform. Content must be honest, lawful, and free of abusive, defamatory, or infringing material. Neesh may remove content that violates these Terms.

10. Prohibited conduct

You agree not to:

• Use the Platform for any unlawful, fraudulent, or harmful purpose.
• Circumvent Neesh to arrange or pay for booked services off-platform in order to avoid fees.
• Attempt to disrupt, reverse-engineer, or gain unauthorized access to the Platform.
• Misrepresent your identity, qualifications, or licensing.

11. Disclaimers

The Platform is provided "as is" and "as available." Neesh does not warrant the quality, safety, or legality of services provided by Masters, the truth or accuracy of listings, or that the Platform will be uninterrupted or error-free. To the maximum extent permitted by law, Neesh disclaims all implied warranties.

12. Limitation of liability

To the maximum extent permitted by law, Neesh and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of the Platform or from services provided by a Master. Neesh's total aggregate liability for any claim relating to the Platform will not exceed the greater of the fees Neesh received in connection with the transaction at issue or US $100.

13. Indemnification

You agree to indemnify and hold harmless Neesh and its affiliates from any claims, damages, or expenses arising out of your use of the Platform, your violation of these Terms, or, for Masters, the services you provide.

14. Termination

You may stop using the Platform at any time. Neesh may suspend or terminate accounts that violate these Terms or that create risk for the community or for Neesh.

15. Governing law

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Los Angeles County, California, unless otherwise required by applicable law.

16. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated through the Platform or by email. Your continued use after changes take effect constitutes acceptance.
